DSEAR Risk Assessment
DSEAR Risk Assessment
It is a legal requirement for employers and the self-employed to assess the risks of fires, explosions and similar events to protect people at risk in the workplace.
We can provide you with specialist consultants who can conduct a DSEAR risk assessment, to ensure you are fully compliant with UK law.
The Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR) places a duty on all UK employers and self-employed persons to ensure they have protected their employees and anyone else who might be at risk of fire, explosion and similar events caused by dangerous substances in the workplace.
Following the regulations, employers have a legal duty to control the risks to the safety of their employees and others from dangerous substances and explosive atmospheres. Responsibility of ensuring that an adequate DSEAR risk assessment has been conducted lies with the employer or ‘responsible person’. In the event that a suitable and sufficient DSEAR risk assessment has not been carried out, the ‘responsible person’ will be held accountable. Due to the dangerous nature of DSEAR, consequences for breaching HSE regulations can be severe, taking the form of heavy fines or even jail terms. To avoid this, it is essential that you ensure your business conducts an adequate DSEAR risk assessment.
Abiding by the Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR)
HSE guidance state that a DSEAR risk assessment must include:
- Identifying the dangerous substances and what the fire and explosion risks are
- Identifying who is at risk
- Removing or reducing the risks involving dangerous substances where possible
- Recording findings, informing employees and others, and providing emergency plans and training
- Identifying the areas of the workplace at most risk and implement measures to avoid or reduce using ignition sources in these areas.
To ensure that an adequate DSEAR risk assessment has been conducted which abides by HSE regulations, a competent person is required. A competent person must have experience, qualifications and expert knowledge on completing risk assessments.
