Under the Control of Noise at Work Regulations 2005, all UK employers have a legal duty to control and reduce the risks associated with noise in the workplace. Under the regulations, employers must make an assessment of the noise present in the workplace and take practical measures to protect their employees.

In the event that the noise at work regulations are not followed, the employer will be held accountable. The employer is responsible for ensuring that an adequate noise risk assessment has been conducted. Failure to do so can result in heavy fines and even jail terms. Therefore, it is essential that you conduct a noise at work risk assessment now.

Noise at Work Regulations 2005

Government guidance stipulates four key provisions which the Control of Noise at Work Regulations 2005 identifies. These are:

  • Assessing the noise which employees may be exposed to over an 8 hour period and ensuring noise limits have been identified
  • Ensuring an adequate noise risk assessment has been carried out and noise levels have been reduced where they are over 87dB(A)
  • Providing hearing protection and the appropriate advice and training for noise levels at 80dB(A) and 85dB(A)
  • Conducting health surveillance if noise exposure is above 85dB(A).

In order to ensure that the Control of Noise at Work Regulations 2005 are being met, a competent person must complete the noise risk assessment. A competent person must have knowledge and experience of conducting a noise risk assessment with the ability to provide training and information where necessary.

We can provide you with expert consultants who will ensure that you are in compliance with UK law.
